Certificate of Free Sale

When products that are manufactured or produced in South Dakota are being exported to another country, a certificate of free sale can be requested. There is no fee for requesting a certificate of free sale.

The certificate of free sale will state:

  • The name and location of where the products are manufactured.
  • The statement that the company is currently licensed and the date of expiration.
  • The statement that the products are freely sold throughout the United States and that there are no prohibitions against the export of these products.

The document will be signed by an employee of DANR and will be notarized.

When requesting a certificate of free sale DANR will need:

  • The name and location of the manufacturing facility.
  • A list of the products that are to be exported.
  • The country of destination.
  • The physical address of where the letter is to be sent.
  • A note if a copy of the license needs to be sent with the letter.
  • Labels if requested.

If an apostille certificate needs to accompany the certificate of free sale, you will also reach out to the South Dakota Secretary of State office. Fees may apply for the affidavit.
