Fertilizer Spills

TO REPORT A FERTILIZER OR PESTICIDE SPILL CONTACT: OFFICE OF EMERGENCY MANAGEMENT (24 HOURS) 605.773.3231

The operator or manager of a bulk commercial fertilizer storage facility shall notify the department of agriculture or the division of emergency and disaster services within 3 hours after a spill of more than 25 gallons of liquid outside the secondary containment area.

The operator or manager of a non-liquid bulk commercial fertilizer storage facility shall notify the department of agriculture or the division of emergency and disaster services within 3 hours after a spill of more than 500 pounds of dry fertilizer outside the secondary containment area.

Do not dispose/use spilled or contaminated material until the South Dakota Department of Agriculture and Natural Resources (DANR) grants approval. Use the Report of Pesticide or Fertilizer Discharge Use/Disposal(Land Application Form) and submit to the DANR PRIOR to using or disposing of contaminated materials.

Regulatory Compliance & Enforcement

DANR Compliance and Enforcement programs ensure compliance with state and federal laws and regulations through the following activities:

  1. Inspection - Conduct fertilizer and soil amendment guaranteed analysis sampling, proof of claims, labeling, storage, production, distribution and recordkeeping inspections to ensure compliance with federal and state laws.
  2. Enforcement - Conducts investigations of alleged agricultural fertilizer and soil amendment law violations on its own initiative or in response to a complaint from the public and assesses fines and penalties against violators.
  3. Licensing / Registration - Licenses fertilizer producers, dealers and distributors and issues storage permits to ensure compliance with state and federal laws. Registers soil amendment products to insure compliance with state and federal law.
